New Delhi (24/7 News Network): A newly amended Information Technology Act has come as a caution for the porn site users, as viewing child porn online, will now become punishable under the IT Act.

Creating and transmitting child pornography was punishable under the the previous law. The amendment added a new clause, which makes browsing, downloading and viewing such materials punishable under the law.

If we analyse the information technology amendment bill, 2008 one thigh is for sure. We Indians are going to be in big mess. Whether it is the power of electronic interception and surveillance or child pornography/pornography or cyber terrorism or any other stupid and thoughtless provision, the end result would remain the same, big mess and trouble. If we analyse the bill in detail it is clear that the hurry and unthoughtfulness of the legislatures has distorted the IT Act, 2000 further to a stage beyond repair. If still they have some common sense remained they must scrap the bill and come up with some good legislative draft.

Now criticizing without details is futile. Here are my two cents:

(a) legal enablement of ict systems is in grave condition and nothing has been done so far. Kindly see http://www.thaindian.com/newsportal/uncategorized/legal-enablement-of-ict-systems-in-india_100155256.html

(b) judiciary at large (some member do know) is not aware about the benefits and use of IT. Kindly see http://www.thaindian.com/newsportal/uncategorized/e-courts-in-india-time-to-act-now_100155220.html

(c) cyber security and cyber forensics expertise is missing. Kindly see http://www.thaindian.com/newsportal/uncategorized/cyber-security-in-india-another-wake-up-call_100155330.html

(d) even the officers of the government of India have admitted that the bill 2008 requires further refinement and strength. Kindly see http://www.thaindian.com/newsportal/sci-tech/it-bill-to-get-more-teeth_100151633.html

(e) the leading techno-legal expert/specialist of India Mr. Praveen Dalal, managing partner of Perry4law, has also criticised the proposed bill. It gets lot of weightage when someone of his caliber and stature criticises legislation.

(f) member of the apex court of India i.e. supreme court of India have severely criticised the weak cyber law of India. Kindly see http://www.thaindian.com/newsportal/uncategorized/it-act-has-to-be-more-deterrent-justice-sirpurkar_100152559.html

(g) cyber law is heading towards a direction that is definitely not good for India. Kindly see http://www.thaindian.com/newsportal/press-release/cyber-law-in-india-where-are-we-heading-to_100152667.html

Despite all this some fools still think the proposed bill is a good one. May god bless them with some insight.
