News Desk: The Delhi High Court on Wednesday refused to restrain cricketer Sachin Tendulkar from taking oath as the Rajya Sabha member, dismissing the petition challenging the cricketer's Rajya Sabha nomination.
However, the court asked the Additional Solicitor General (ASG) AS Chandhiok to reply on the issue by the next date of hearing.
The petition claimed that Sachin's nomination to the Upper House of Parliament was unconstitutional as people from art, science, literature and social services could be nominated.
The PIL objected to the nomination saying the sports does not fall under any category as mentioned in the Constitution for Rajya Sabha.
A bench of Acting Chief Justice AK Sikri and Justice Rajiv Sahai Endlaw asked how the sports category was covered while nominating a sportsman to the Rajya Sabha.
However, Chandhiok argued that the nomination has been approved by the President of India and the court cannot interfere in the matter.
Sachin's nomination was questioned by the petitioner Ram Gopal Singh Sisodia, a former Delhi MLA. He challenged the nomination on the ground that the cricketer does not meet any of the qualifications as prescribed under Article 80 of the Constitution to get nominated to the Upper House.
